1. PURPOSE
These General Terms and Conditions of Sale (GTCS) govern the terms of sale for the paintings generated by artificial intelligence offered by Next New Art on its website.
2. PRODUCTS
Next New Art offers for sale paintings created from generative artificial intelligence. The images of the paintings are presented for illustrative purposes and may vary slightly from the delivered products due to the nature of their design. The main characteristics of the paintings are described on the website.
3. PRICES
The prices of the paintings are indicated in euros (€) and are subject to change at any time by Next New Art. The price applicable to an order is the one in effect at the time of the order’s validation by the customer.
4. ORDERS
The customer places their order by following the ordering process available on the Next New Art website. The customer’s validation of the order constitutes acceptance of these GTCS. Next New Art reserves the right to refuse any order for legitimate reasons.
5. PAYMENT
Payment is made online at the time of the order by credit card or any other means of payment accepted by Next New Art. Payments are secured through reliable payment methods.
6. DELIVERY
Delivery times and costs are indicated during the ordering process. The paintings are delivered to the address provided by the customer during their order. Delivery times may vary depending on product availability and destination.
7. RIGHT OF WITHDRAWAL
In accordance with current legislation, the customer has a withdrawal period of 14 days from the receipt of the painting to exercise their right of withdrawal, without having to provide reasons or to pay penalties, with the exception of return costs.
8. INTELLECTUAL PROPERTY
The intellectual property of the paintings generated by artificial intelligence remains the property of Next New Art. However, the purchase of a painting grants the customer a right to private use of the painting without the right to reproduce or commercially distribute it.
9. PERSONAL DATA
Next New Art commits to respecting the confidentiality of the personal data of its customers and to use it solely within the context of the commercial relationship, in accordance with French data protection laws.
10. DISPUTES
In the event of a dispute, the competent courts will be those of the location of the head office of Next New Art, namely the Marseille court (13), in accordance with French legislation.
These general terms and conditions of sale constitute a contractual agreement between Next New Art and the customer. We recommend reading them carefully before placing any order.
